Our Contract 1.2 All orders placed are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgement of your order does not constitute legal acceptance of your order.

| 2. | Price & Payment 2.1 The price payable for the goods ordered is as set out on this web site at the time you place your order plus any charges for delivery and insurance as shown. 2.2 We reserve the right to change the price of commodity goods, such as copper, due to market conditions but we will confirm the prevailing price with you before accepting your order. We are not obliged to accept your order for such goods and may decline it or limit the order quantity. 2.3 On occasion, the prices payable of goods advertised on our web site may differ from those prices offered in the then current catalogue or at one of our trade counters, and we are under no obligation to honour any web site price if there is such a difference. 2.3.5 Please note that all goods 1.5 metres and over in length (including packaging) will incur an extra delivery surcharge when added to the shopping cart. 2.4 Occasionally an error may occur with our web site and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price. The Order Acknowledgement email and order number are not an order confirmation or order acceptance from us. Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it. Where items are despatched separately, our acceptance of the order in respect of each item takes place when that item is dispatched. Our carrier will make every reasonable effort to contact you to make delivery, but if they are unable to do so then your order will be cancelled and payment refunded to your card. 2.5 Subject to clause 2.6, we must receive payment for the whole of the price of the goods you order, and any applicable charges for delivery, before your order can be processed unless we have agreed otherwise in advance in writing. 2.6 If you are an account customer, payment shall be made in full at the end of the month following the date of invoice. Time shall be of the essence for payment. We may revoke credit if you fail to make payment when due. If payment is not made when due, interest is payable at the rate of 3 per cent over bank base rate, then current base rate on the amount outstanding from the due date for payment until receipt by us of the full amount (including any accrued interest) whether before or after judgement, together with any reasonable legal or other recovery costs. 2.7 Gift vouchers are the equivalent of cash and should be treated as such. Vouchers are only redeemable for goods and services provided by The 12 Volt Shop at date of use. Gift Vouchers cannot be redeemed exchanged for cash. Vouchers which are altered or cancelled will not be accepted. 2.8 If you pay by cheque, please note that goods will not be despatched until funds have cleared. We use the services of cheque warranty companies. These companies will record information about your cheque and will use personal data about you (or information about your company) in order to enable them to collect a debt and may carry out a credit check where they deem it necessary. They will charge you an administrative fee for collection of a dishonoured cheque. |

Delivery & Title 3.2 Delivery of goods can take up to 14 full working days from date of order, we have no obligation to deliver on specific days or at specific times. No employee of the 12 Volt Shop is authorised to change these delivery conditions. 3.3 For reasons of health and safety and to avoid any property damage, large items can only be delivered to a ground floor location at the delivery address. You must therefore make your own arrangements at your own risk if the relevant item needs to be transported from the delivery location. 3.4 Upon delivery of the goods to you, the goods shall be at your risk. In spite of delivery having been made, title in the goods shall not pass to you until you have paid the price for the goods in full and no other sums whatsoever shall be due to us from you. Until title in the goods passes from us, you shall hold the goods on a fiduciary basis as bailee and shall store the goods at your own cost separately from all other goods in your possession and marked in such a way that they are clearly identified as our property. 3.5 Delivery will only be made to the address of the cardholder or payee. Goods will not be made to secondary addresses. Where an attempt is made to change the delivery address after an order is made, the order will automatically be cancelled. 3.6 Delivery will not be made if the address given is a PO box number or the address is a hotel or temporary residence. The only exception being to the owner of the hotel or residence. 3.7 Delivery is to the UK only. The UK is deemed as Mainland Britain, Highlands & Islands (excluding the Channel Islands) and Northern Ireland. Unless otherwise arranged. 3.8 Goods that are returned to us because the delivery company were unable to deliver the goods for whatever reasonable reason ie: no one at home, unreasonable delivery location, unable to obtain a signature, shall be refunded less delivery and 15% handling charge. 3.9 Delivery of goods during promotions, offers and sales are made using carriers of our own choice (see 3.2). This does not include overnight 24hour, 48hour or any form of special delivery or timed delivery. We retain the right to use the cheapest form of delivery available and will not be held responsible for loss or damage to goods in transit howsoever caused. Where a customer requests delivery other than those terms set out above normal carriage rates shall apply. |

Availability |

Cancellation & Returns 5.2 On cancellation for whatever reason, you must return the goods to us at your cost. Where the goods are being returned because they are faulty or incorrect goods, we will meet the cost of return but we must (for insurance reasons) nominate the carrier. 5.3 Where goods are returned that are not faulty or damaged (see 5.2, 5.6), all costs of carriage will be deducted from any refunds made. 5.4 Note. Refunds will only be made upon the safe return of said goods, (in original packaging) on the basis that they conform to the reasons for return. 5.5 Refunds on goods lost in transit can take in excess of 30 days from notification (as stipulated by our carriers), prior to refunds being made. We reserve the right to investigate the circumstances of loss prior to any refund or recompense being paid. 5.6 Note: All goods are deemed to be of saleable quality and at a price that reflects this. Goods returned because of quality issues will be refunded less postage. Goods returned for any other reason will be less shipping and less a 15% handling charge. |

Liability 6.2 We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. 6.3 This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence. 6.4 Goods are intended for use in the UK and we make no warranties that the goods are suitable for use outside the UK, or comply with any laws, regulations or standards of any jurisdiction outside the UK. |

Limited Companies - Guarantee 7.2 If the limited company goes into receivership, liquidation or administration the guarantor will pay to the receiver, liquidator or administrator, as the case may be, such sum as will enable him to pay all monies owed to us by the limited company. |
